Refund policy

We want you to be certain about your piece. This policy explains your right to withdraw from the contract, how to return a garment, and what happens if a piece arrives faulty.

It applies to all orders placed on www.amedare.com and reflects Directive 2011/83/EU on Consumer Rights, Directive (EU) 2019/771 on the sale of goods, and the Polish Act on Consumer Rights of 30 May 2014.

PART A

Your Right to Withdraw

The right

If you are a consumer, you may withdraw from the contract within 14 days, without giving any reason and without incurring any charge for exercising the right.

The 14 days run from the day on which you, or a person nominated by you other than the carrier, takes physical possession of the goods. Where an order is delivered in several parts, the period runs from the day you receive the last part.

You may also withdraw at any time before the goods are dispatched.

How to withdraw

Send us a clear statement of your decision to withdraw, before the 14 days expire, to contact@amedare.com.

You may use our model withdrawal form, but you are not obliged to. Any unambiguous statement is sufficient. Please include your order number so we can identify the order quickly.

Download the form as a PDF — ready to print or fill in on screen.

We will confirm receipt of your withdrawal by email without delay. To meet the deadline it is enough that you send your statement before the 14-day period expires.

Sending the piece back

Send the piece back to us within 14 days of the day you notify us of your withdrawal. It is enough that you dispatch it within that period.

Please include the order number in the parcel.

Who pays to send it back

You do. Return postage is arranged and paid by you, and it is not reimbursed. This applies to every return made under your right of withdrawal, whatever the reason for it.

The one exception is a piece that is faulty, damaged in transit or not what you ordered. There we cover the return in full — see Part B.

Please use a tracked service and keep proof of postage. Until the piece reaches us, or you show us that you have sent it, the risk of loss in return transit is yours, and we cannot refund a parcel that never arrives.

What we refund

Once you withdraw, we refund all payments we received from you, including the standard delivery cost we charged for sending the order to you.

Two limits apply, and they are the only two:

  • More expensive delivery. If you chose a delivery method more expensive than our cheapest standard option, we refund the cheapest standard cost. The difference is not refunded.
  • Partial return. If you return only part of an order and keep the rest, the original delivery cost is not refunded, because the delivery was still made.

We refund within 14 days of receiving your withdrawal statement, to the same payment method you used, at no cost to you. We will not use a different method unless you expressly agree.

We may withhold the refund until we have received the piece back, or until you provide proof that you have sent it back, whichever is earlier.

Condition of the Piece

Try the piece on. Unpack it, look at it, put it on, check the fit, the cut, the weight of the fabric, how it sits with what you already own. The law entitles you to examine a garment as fully as you could if you were buying it in person, and we hold you to nothing stricter. We will never charge you for it.

Wearing it is a different thing. Trying a coat on at home tells you everything you need to know about it. Wearing it out — to work, to dinner, for an evening — is not examination, and the law does not protect it. You are liable for the reduction in the value of the piece caused by handling that goes beyond examining it (Article 34(4) of the Polish Act on Consumer Rights), and that reduction is deducted from your refund.

We sell each garment as new, once. A piece carrying someone else's fragrance, deodorant, hair or a day of city air cannot be sent to the next person as new, and we will not do it. Where that has happened the piece has lost its whole value to us, and the refund is nil.

How a return is assessed

Every piece is photographed before it is packed. A return is assessed against that record.

Condition on return Refund
Tried on. No marks, no scent, tags and returns tag in place. Creasing that airing or steaming resolves Full
Any trace of having been worn on the body — fragrance, deodorant, cosmetics, body odour, hair, fibres from other clothing Nil
Any trace of having been worn outside — soiling at the hem, cuffs or lining, pilling, stretching or loss of shape, pulled threads, pressure marks from a bag or belt Nil
Altered, shortened, taken in, re-buttoned, laundered or dry-cleaned, or returned incomplete Nil
Returns tag removed, detached or tampered with Assessed as above; removal is treated as evidence that the piece was worn

The outcome is full or nil because the loss of value is. A garment we can offer as new has lost nothing. A garment we cannot offer at all has lost everything. With pieces made in the quantities we make them, there is rarely anything in between.

Where a piece can be fully restored by professional cleaning, we deduct only what that costs. In our experience of these fabrics, fragrance and body oils in wool and cashmere cannot be removed to that standard.

The returns tag

Every piece is dispatched with a numbered Âme Dare returns tag attached to the exterior. Try the piece on with the tag in place — it does not interfere. Removing it is not necessary to examine a garment, and we treat its removal as evidence that the piece was worn.

Where the refund is nil

The piece remains yours. We will return it to you at your cost, or hold it for collection — whichever you prefer. If you would rather not have it back, tell us and we will dispose of it responsibly.

We do not decline a withdrawal. Your right to change your mind is absolute and we make no attempt to limit it. What we do is settle it accurately: you receive what the piece is still worth, and where it is worth nothing, that is nil.

We will always put an assessment to you in writing, with photographs of the piece as it left us and as it came back, before we act on it. If you disagree, tell us and we will look again. If we still disagree, the routes in Part D are open to you.

PART A · CONTINUED

No Exceptions

The right of withdrawal applies to everything we sell, including pieces made after you place your order.

We work largely to order. Our releases are small, and rather than hold finished stock we cut and sew a piece once it has been bought. That is how we are able to make what we make — but it is our production model, not a restriction on you. Producing a garment after you order it does not remove your right to change your mind.

We do not offer made-to-measure or personalised garments, and we do not exclude any piece from return.

PART B

Faulty, Damaged or Incorrect Pieces

This part is separate from your right of withdrawal and applies in addition to it.

Our liability for conformity

We are liable for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within two years of delivery (Articles 43a–43g of the Polish Act on Consumer Rights).

A lack of conformity that becomes apparent within two years of delivery is presumed to have existed at the time of delivery. You do not have to prove that it did.

There is no deadline by which you must report a fault. Reporting it promptly helps us resolve it, but a later report does not affect your rights.

What you can ask for

If a piece does not conform to the contract, you may ask us to repair or replace it. We will do so within a reasonable time, without significant inconvenience to you, and at our cost — including the cost of sending the piece back to us.

You may ask for a price reduction, or withdraw from the contract and receive a refund, if:

  • we refuse to repair or replace the piece, or fail to do so;
  • the lack of conformity persists after repair or replacement;
  • the lack of conformity is serious enough to justify it without first asking for repair;
  • it is clear from the circumstances that we will not repair or replace within a reasonable time or without significant inconvenience.

You cannot withdraw from the contract if the lack of conformity is immaterial.

How to make a complaint

Write to contact@amedare.com with your order number, a description of the issue, photographs showing it, and what you would like us to do.

We will respond to your complaint within 14 days. If we do not respond within that period, the complaint is deemed accepted (Article 7a of the Polish Act on Consumer Rights).

Complaints may also be sent by post to ul. Kolejowa 43/144, 01-210 Warszawa, Poland.

Damage in transit

If a parcel arrives visibly damaged, we ask you — where possible — to refuse the delivery, or to ask the courier to record the damage. If you notice damage after opening the parcel, photographs of the outer packaging and the garment, sent to us as soon as you can, help us pursue the claim with the courier.

This is a request, not a condition. Your rights above apply regardless of when or how you report the damage.

Lost parcels

Until you take physical possession of the goods, the risk of loss is ours. If your parcel has not arrived, write to us and we will open an investigation with the courier. Once loss is confirmed we will send a replacement or refund you in full.

Please tell us as soon as you can — couriers apply their own claim deadlines and an early report helps us recover the loss — but your rights do not depend on it.

PART C

What Is Not Covered

  • Normal wear. Fading, pilling, thinning at points of friction and loss of shape arising from use over time are characteristics of natural fibres, not defects.
  • Damage caused by misuse or incorrect care, including cleaning contrary to the care label. Our Garment Care page sets out how each fabric should be treated.
  • Alterations carried out by you or a third party.
  • Gift cards, which are not returnable, without prejudice to your statutory rights.

PART D

Complaints and Out-of-Court Resolution

If you are not satisfied with how we have handled a matter, write to contact@amedare.com and we will review it.

If we cannot resolve it between us, you may use the routes below. Participation is voluntary for both sides, and we consider each request in good faith.

  • Wojewódzki Inspektorat Inspekcji Handlowej w Warszawie — mediation and the permanent consumer arbitration court. ul. Sienkiewicza 3, 00-015 Warszawa. wiih.org.pl
  • Powiatowy or miejski rzecznik konsumentów — free advice and assistance, available in your district or city of residence in Poland.
  • UOKiK register of out-of-court dispute resolution bodiespolubowne.uokik.gov.pl
  • Consumer helpline — 801 440 220 or 22 290 89 16 (Poland).
  • If you live in another EU country — the European Consumer Centre network assists with cross-border disputes. In Poland: Plac Powstańców Warszawy 1, 00-030 Warszawa, konsument.gov.pl

The European Commission's Online Dispute Resolution platform ceased operating on 20 July 2025 and is no longer available.

PART E

Repeated Returns

We keep the right to decline future orders, to require payment in advance by a different method, or to close an account, where a customer repeatedly returns pieces in a condition that prevents resale, repeatedly cancels orders after production has begun, or otherwise uses the returns process in a way that is not consistent with its purpose.

This does not affect your rights in relation to any order already placed.
