Terms of service
These Terms and Conditions govern your use of www.amedare.com and the purchase of our garments. Please read them before placing an order. By placing an order you accept them.
These Terms do not limit your rights as a consumer under Polish or European Union law. Where any provision conflicts with a mandatory rule protecting consumers, that rule prevails and the remainder of these Terms continues to apply.

Definitions
Consumer — a natural person entering into a contract with us for purposes not directly connected with their business or professional activity, and an individual entrepreneur entering into a contract that is not of a professional character for them, within the meaning of Articles 22¹ and 385⁵ of the Polish Civil Code.
Business customer — any other purchaser. Sections 13 and 15 apply differently to business customers, as stated there.

Eligibility
You must be at least 18 years old to place an order.

Our Garments
Our pieces are made in small, limited batches. Product photography is representative. Minor variation in colour, texture, weave and finish may occur due to screen settings, photographic lighting and the natural characteristics of the fabrics we use — these are inherent to the material and are not defects.
Measurements given in the Size & Fit guide are approximate and subject to normal manufacturing tolerance.

Orders and Formation of Contract
Placing an order is an offer to purchase.
After you place an order you will receive an automatic email acknowledging that we have received it. This acknowledgement is not acceptance of your order.
The contract between us is concluded when we dispatch your order and send you a shipping confirmation email. Where an order contains several pieces, a separate contract is concluded for each piece as it is dispatched.
Until dispatch we may decline or cancel an order, in whole or in part, where:
- the piece is no longer available or the batch has sold out;
- there is a manifest error in the price or product description;
- we are unable to verify your payment or delivery details, or we reasonably suspect fraud or unauthorised use of a payment method;
- we cannot deliver to the address given, including where delivery is restricted by sanctions or export controls;
- the order appears to be placed for commercial resale;
- you have a history of orders cancelled after production, or of returns in a condition that prevented resale.
If we decline or cancel an order, we will tell you and refund any payment in full and without delay.
You may cancel your order at any time before dispatch, free of charge, by writing to contact@amedare.com. We will refund you in full.
Because we begin making a piece shortly after it is ordered, cancelling early costs neither of us anything — see When we take payment below. Where production has already begun we ask you to contact us as soon as you can so that we can stop work, but this does not limit your right to cancel.

Personal Use and Resale
Our garments are sold for personal use. We do not sell for commercial resale, and we may decline orders that appear to be placed for that purpose — including orders of unusual quantity, repeated orders of the same piece in multiple sizes, and orders shipped to known reseller addresses.

Prices and Payment
All prices are shown in the currency selected on the website and include VAT where applicable. Delivery costs are shown separately at checkout before you confirm your order. The total amount payable is displayed before you place the order.
Where we announce a price reduction, we also display the lowest price applied to that piece during the 30 days before the reduction, in accordance with Article 6a of Directive 98/6/EC and the Polish Act on Price Disclosure.
We may change prices at any time. Changes do not affect orders already placed.
Payment methods are shown at checkout. Payments are processed by our payment service providers; we do not receive or store your full card details. Bank charges and currency conversion costs applied by your own bank or card issuer are your responsibility.
Discount codes are valid only for the period stated, apply only to the items specified, and cannot be combined unless we say otherwise.
When we take payment
When you place an order by card, the amount is reserved on your card — your bank holds it, but it is not yet transferred to us. You may see it in your banking app as pending.
We take the payment when we begin making your piece, normally within two business days of your order. If you cancel before then, we release the reservation and nothing is charged; your bank lifts the hold, usually within a few working days.
Some payment methods — including BLIK and Przelewy24 — are charged immediately at checkout and cannot be reserved in this way. If you cancel such an order, we refund you in full.

Delivery
Delivery times, methods, costs and customs treatment are set out in our Shipping Policy, which forms part of these Terms.
Risk of loss and damage passes to you when you, or a person you have nominated other than the carrier, takes physical possession of the goods.

Right of Withdrawal, Returns and Refunds
If you are a consumer, you have a statutory right to withdraw from the contract within 14 days without giving a reason. The conditions, the procedure, the effect on shipping costs and the circumstances in which we may reduce a refund are set out in our Returns & Refunds Policy, which forms part of these Terms and includes the model withdrawal form.

Conformity of Goods and Complaints
We are liable for any lack of conformity of the goods with the contract, on the terms set out in Articles 43a–43g of the Polish Act on Consumer Rights. The complaint procedure is set out in our Returns & Refunds Policy.

Your Account and Your Data
You may create an account to manage your orders. You are responsible for keeping your credentials confidential and for activity carried out through your account. Tell us immediately if you suspect unauthorised access.
We may suspend or close an account used in breach of these Terms, for fraudulent activity or for commercial resale.
Your personal data is processed as described in our Privacy Policy.

Intellectual Property
All content on this website is owned by us or licensed to us, and is protected as set out in our Legal Notice. You may not copy, reproduce, distribute or use it commercially, use our designs to manufacture goods, or use it to train artificial intelligence systems, without our prior written consent.

Liability
If you are a consumer
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for intentional misconduct or gross negligence, for lack of conformity of the goods with the contract, or for any other liability that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss, or for loss that was not reasonably foreseeable at the time the contract was concluded.
If you are a business customer
Our total liability arising out of or in connection with a contract, whether in contract, tort or otherwise, is limited to the price paid for the goods concerned. We are not liable for loss of profit, loss of business, loss of anticipated savings or any indirect or consequential loss. This limitation does not apply to damage caused intentionally.
We do not guarantee that the website will operate without interruption or error.

Circumstances Beyond Our Control
We are not liable for failure or delay in performing our obligations where this is caused by events outside our reasonable control — including natural events, fire, flood, epidemic, war, civil unrest, strike or industrial action, failure of telecommunications networks, acts of government, and delays or refusals by customs authorities. Where such an event occurs we will tell you and, if the delay is substantial, you may cancel the affected order and receive a full refund.

Governing Law and Disputes
These Terms and any contract concluded under them are governed by Polish law.
If you are a consumer
This choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you are habitually resident. You may bring proceedings before the courts of the country in which you are domiciled, and we may bring proceedings against you only before those courts, in accordance with Articles 17–19 of Regulation (EU) No 1215/2012. Information about out-of-court dispute resolution is set out in our Returns & Refunds Policy.
If you are a business customer
The courts having jurisdiction over our registered address in Warsaw, Poland have exclusive jurisdiction.

Changes to These Terms
We may update these Terms. The version in force at the time you place an order is the version that applies to that order — later changes do not affect contracts already concluded. Substantive changes will be published on this page at least 14 days before they take effect.
17
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
